These Terms of Service (“Terms”) govern your access to and use of CheckDMs (the “Service”), provided through checkdms.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CheckDMs is an Instagram comment-triggered messaging automation platform that helps creators and businesses automate replies, follow requests, and direct messages in response to user interactions such as comments. The Service operates through the official Meta API and only acts after a user-initiated trigger that you configure.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for ensuring your use complies with all applicable laws and with Meta’s Platform Terms and policies.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

• Send unsolicited, spam, or bulk cold messages to users who have not interacted with your content.
• Scrape data, harvest followers, or collect information in violation of Meta policies.
• Violate any applicable law or the rights of any third party.
• Distribute malware, or attempt to disrupt or gain unauthorized access to the Service.

Automations must always be initiated by a genuine user interaction (such as a comment, story reply, or message). Misuse may result in suspension or termination.

5. Subscriptions and Payments

Paid plans are billed through Razorpay (UPI, cards, and netbanking). Fees are charged in advance on a monthly basis and are non-refundable except as described in our Refund Policy. We may change pricing with prior notice.

6. Third-Party Platforms

The Service integrates with Instagram and Facebook through Meta. Your use of those platforms is subject to their own terms. We are not responsible for changes to, or the availability of, third-party platforms or APIs.

7. Data and Privacy

Our handling of your data is described in our Privacy Policy. You can request deletion of your data at any time as described in our Data Deletion Instructions.

8. Intellectual Property

The Service, including its software, design, and content, is owned by CheckDMs and protected by intellectual property laws. You retain ownership of the content and messages you create.

9. Disclaimer and Limitation of Liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, CheckDMs is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Termination

We may suspend or terminate your access if you violate these Terms or Meta policies. You may cancel your account at any time.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
